As you may or may not know, Nathen Barton has already been found guilty—of course, pending appeal—of inducing phone calls to a company called LeadPoint. LeadPoint not only won their case against Barton but secured $40,000 in sanctions and damages. While the case is pending appeal, one fact is undeniable: Barton filed information designed to trick companies into calling him.
We’ve obtained depositions where Barton admits to “investigating” by:
- Using fake names when receiving calls
- Fabricating identities to provoke TCPA violations
The court, the police, and federal authorities would likely call this identity theft. Barton, however, seems to believe that inducing calls/texts under false pretenses is justified as long as he’s, quote, “investigating”, quote.
Funny how that word—”investigating”—somehow excuses fraud when Barton says it.
I suppose criminals could break into someone’s house and say they’re, quote, “investigating”, quote, the contents. Either way, Barton has been caught on tape using fake names. We’re working to obtain those recordings to post here for all to hear.
